Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hawook platform (the websites at app.hawook.com and hawook.com, and any related services we offer). By using the Hawook platform, you agree to these Terms. If you don't agree, please don't use the platform.

The Hawook platform is operated by The Chokdee Group Co., Ltd, a Thai-registered company with offices in Phuket, Thailand ("Hawook," "we," "our," or "us").

1. What the Hawook platform is

Hawook is a curated property discovery and brokerage platform. We review property in Phuket against an independent editorial framework and publish our assessments. We help foreign and Thai buyers find suitable freehold property, coordinate viewings, and facilitate purchases through licensed brokerage relationships with developers.

Hawook is not:

  • A legal service or law firm — we're not your lawyer
  • A financial adviser — we don't give regulated investment advice
  • A tax adviser — we don't give regulated tax advice
  • A real estate appraiser — we don't issue formal valuations
  • A construction or engineering professional — we don't inspect buildings to professional structural standards
  • An insurance broker, currency exchange, or money transfer service

While we share research and opinion to help you make decisions, anything material — signing a purchase agreement, transferring money, structuring ownership — should involve appropriate licensed professionals. We can recommend competent ones.

2. Eligibility and accounts

To use the Hawook platform you must be at least 18 years old and capable of forming a legally binding agreement under your home jurisdiction's law.

Some Hawook features require a free account. When you create an account, you agree to:

  • Provide accurate information
  • Keep your password confidential and not share account access with others
  • Notify us promptly if you suspect your account has been compromised
  • Be responsible for activity that occurs under your account

We may suspend or terminate accounts that breach these Terms, that we believe to be fraudulent or abusive, or that are inactive for prolonged periods.

3. Editorial content and accuracy

The Hawook platform publishes editorial content including project reviews, area guides, market commentary, and the "Hawook's Take" and "Hawook Verdict" sections for each project.

This content is our opinion, not fact. We aim for accuracy and we research thoroughly, but property market conditions change, developer circumstances evolve, and our editorial assessments reflect our judgment at the time of writing. Subsequent events may make any review out of date.

You should not make a purchase decision based on Hawook content alone. Always:

  • Visit projects in person before buying
  • Verify pricing, foreign quota, and availability with the developer directly
  • Engage your own legal counsel to review the sale and purchase agreement
  • Engage your own tax adviser for cross-border tax implications
  • Engage a buyer's agent or trusted intermediary if you want a fully independent voice in the transaction

We use reasonable care in compiling content but make no warranty that any specific data point — price, availability, completion date, foreign quota status, amenity, layout, or any other fact — is current or correct at the moment you read it.

4. Brokerage services and commissions

Where Hawook has an agency agreement with a developer, we may earn commission if you ultimately purchase a unit in that developer's project after being introduced through the Hawook platform.

You don't pay Hawook directly for our editorial content or for buyer introductions. Our compensation comes from the developer side of the transaction, in line with standard practice for property brokerages in Thailand.

We aim to keep our editorial content independent from commission arrangements. We list projects we'd recommend regardless of whether they're agency partners; we won't list projects we wouldn't recommend just because we could earn commission on them. If you'd like to understand a specific project's commission structure or have any concerns about how we're compensated, please ask.

If you'd prefer to engage Hawook on a buyer's-agent basis where you pay us directly and we have no developer-side compensation, we can discuss that arrangement. Get in touch.

5. Lead enquiries and introductions

When you submit a lead enquiry through the Hawook platform — whether via a form, the AI Concierge, WhatsApp, email, or any other channel — you authorise us to:

  • Contact you in response to your enquiry, including by email, WhatsApp, phone, or other channels you've shared
  • Share your enquiry details with relevant developers, our partner brokers, or other Hawook team members involved in helping you
  • Maintain your enquiry data in our internal CRM and lead-management systems for the purpose of providing the service

If you also opted in to our newsletter, you'll receive ongoing property-related editorial communications. You can unsubscribe at any time.

If you signed up to follow specific projects, you'll receive notifications when those projects have updates. You can change or cancel follow notifications at any time in your account settings.

6. User conduct

When using the Hawook platform, you agree NOT to:

  • Use the platform to send unsolicited commercial messages to anyone
  • Attempt to access accounts that don't belong to you, or attempt to bypass authentication or content gates
  • Scrape, harvest, or mass-download Hawook editorial content without our written permission
  • Reverse-engineer the platform, attempt to extract source code, or attempt to compromise our infrastructure
  • Submit fraudulent lead enquiries, fake reviews, or false information about yourself
  • Use the platform in any way that could damage, disable, overburden, or impair our services
  • Use the platform in a way that violates any applicable law

We reserve the right to suspend or terminate access for violation of these conduct rules.

7. Intellectual property

The Hawook platform and its content — including editorial reviews, photos, illustrations, graphics, the Hawook Score framework, the Hawook Verdict format, our brand and visual identity — are owned by Hawook or licensed to us. We grant you a limited, personal, non-commercial right to access and use this content while using the platform.

You may:

  • Browse, read, and share Hawook content for personal, non-commercial use
  • Quote short excerpts of our editorial content with attribution and a link to the original page

You may not:

  • Copy substantial portions of our editorial content
  • Republish Hawook reviews or content on other websites
  • Use Hawook content for commercial purposes including but not limited to your own real estate marketing
  • Use the Hawook name, logo, or visual identity in any way that could create confusion about the source of content or services

Third-party content (developer images, brochures, plans) is used with permission or under fair-use principles. If you're a rights holder and believe content is being used inappropriately, contact us at hello@hawook.com.

8. Third-party content and links

The Hawook platform contains content from third parties: developer photos, brochures, marketing material, and external links. We don't endorse or take responsibility for third-party content. If you click out to an external site, that site's terms govern your interaction with it.

9. Disclaimers

The Hawook platform and content are provided "as is" without warranties of any kind. We disclaim all implied warranties to the maximum extent permitted by Thai law and any other applicable law.

Without limiting the above, we don't warrant that:

  • The platform will be uninterrupted, secure, or error-free
  • The platform will be free of viruses or other harmful components
  • Any specific content is accurate, complete, or current
  • Property described on the platform is available, properly licensed, or suitable for your specific purposes
  • Investment outcomes (rental yields, capital appreciation, etc.) discussed or modelled on the platform will be realised

Property purchases involve substantial risk. Past performance of any project, developer, or area does not guarantee future results. Make decisions accordingly.

10. Limitation of liability

To the maximum extent permitted by law, Hawook's total liability to you arising from your use of the platform — for any cause, theory of liability, or claim — is limited to:

  • For users who haven't engaged Hawook directly on a paid basis: 5,000 THB, or the equivalent in your local currency
  • For users who've engaged Hawook on a buyer's-agent basis: the total fees you've paid Hawook in the 12 months preceding the claim

We're not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, lost opportunity, or business interruption, even if we've been advised of the possibility of such damages.

These limitations don't apply where the law doesn't permit them — for example, in cases of fraud or wilful misconduct.

11. Indemnification

You agree to indemnify and hold Hawook harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your misuse of the platform
  • Your violation of any law or third-party right
  • Content you submit to or through the platform

12. Termination

You can stop using the Hawook platform and delete your account at any time. Email hello@hawook.com to request account deletion. Some data may be retained as described in our Privacy Policy.

We can terminate or suspend your access for breach of these Terms, suspected fraud, prolonged inactivity, or business reasons (with reasonable notice where possible). Termination doesn't affect rights and obligations that, by their nature, should survive — such as intellectual property rights, indemnification, limitation of liability, and dispute resolution.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated by email to registered users and via a banner on the platform. The "Last updated" date at the top of these Terms will reflect the most recent revision. Continued use of the platform after a change means you accept the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Thailand, without reference to conflict-of-law principles.

Any dispute arising from or related to these Terms or your use of the platform will be brought exclusively in the courts of Phuket, Thailand.

If you're an EU consumer, this clause doesn't override mandatory consumer protection rights you have under your home country's law.

15. Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
